COMMUNITY AMBASSADOR PROGRAM TERMS & CONDITIONS
The T&Cs (“T&Cs”) are created for and on behalf Str8bat Solutions India Private Limited (hereinafter referred to as “Company”, “we”, “us”, “our” which expression(s) shall include its subsidiaries, affiliates, and its holding company, as the case maybe).
The T&Cs shall govern the Community Ambassador Program (the “Program”) available on our website www.str8bat.com or mobile application Str8bat Cricket (available on Apple app store as well as Google play store)(collectively referred to as “Platform”), in which the Company is offering to its customers owning Company’s cricket bat sensor (“Customer” or “You”), the opportunity to win rewards.
The Company reserves the right to cancel or amend the T&Cs at any time without prior notice.
1. ELIGIBILITY
1.1 Except for any employees of Str8bat, the Program is offered to all current Customers of the Company who possess the Sensor. Ownership of the Sensor is limited to individuals only and is limited to one Sensor per individual.
2. MEMBERSHIP
2.1 The Program is offered by the Company to its Customers who are willing to participate in the Program by letting their family or friends use their Company’s cricket bat sensor (“Sensor”).
2.2 Only Sensors brought, registered with, and used in India will be taken into consideration for the purposes of this Program.
2.3 The Company will extend certain perks and privileges as described in more detail herein, and additional offers may be extended from time to time.
3. ACCEPTANCE OF TERMS
3.1 By participating in the Program, the Customer agrees to the T&Cs, rules, regulations, policies, and procedures of the Program, which constitutes a legal agreement between you and us.
3.2 The Company reserves the right to disqualify Customers who have violated any of the Program T&Cs.
4. COMPANY'S RIGHT TO CHANGE/CANCEL PROGRAM
4.1 The Company may alter, limit, modify or terminate the Program, its structure, any other feature of the Program, or these T&Cs in its sole and absolute discretion at any time and no communication of such alteration, amendment or update shall be made to you. It is recommended that you regularly check this T&Cs to apprise yourself of any updates.
4.2 Your continued participation in the Program will confirm your acceptance of such changes.
5. DURATION OF THE PROGRAM
5.1 This Program shall commence from 01st November 2022 at 12:00:01 a.m. (IST) to 31st January 2023 at 11:59:59 p.m. (IST) (“Program Period”).
6. PROCESS OF PARTICIPATION
6.1 The Customer can participate in the Program by letting their parents, siblings, relatives, friends, neighbours, or acquaintances (“Lead”) use their Sensor.
6.2 The Sensor can only be used by the Lead for at least 1 (one) session, by signing up on our Platform.
6.3 The Lead must provide information accurately and completely while participating and signing up on the Platform.
6.4 The Company at its sole discretion reserves the right to accept or reject any Lead from the Program.
6.5 To be eligible for any cashbacks under this Program, the consumer must have a valid UPI ID. Any such UPI information must be provided by the consumer at the beginning of the cashback processing procedure. The Company shall not be accountable for issuing any cashbacks in the event of any delay or incorrect information given by the Customer.
6.6 The Lead is fully aware that in order to participate in the Program, he or she must only sign up once using their email address; any fraudulent registrations or registrations made by the same person using numerous email addresses would disqualify them from the Program. When a Customer receives a reward, cashback, or other advantage from the Program through such fraudulent activity, they are responsible for returning that reward, cashback, or benefit to the company. Any such fraudulent conduct on the part of the Customer shall have legal repercussions.
6.7 Any Customer (individual who owns the Sensor) themselves is prohibited from participating as a Lead by using the Sensor belonging to another Customer for the purpose of this Program.
7. REWARD
7.1 With every new sign up of Lead, the Customer is rewarded with INR 50 (Indian Rupees fifty) instant cashback subject to maximum cashback of INR 2,500 (Indian Rupees two thousand five hundred) in a month and the Lead is granted free 1 (one)month’s subscription on our Platform. The Customer who originally presented the Lead for signing up on the application will be the only one eligible for the aforementioned cashback.
7.2 The Customer whose Sensor was last used by the Lead shall be entitled to a reward of 20% (twenty percent) of the subscription fee post tax deduction in the event that a Lead subscribes to any of the subscription plans available on the Platform before or after the expiration of their free subscription.
7.3 Rewards beyond cashback: The Company retains the full right to develop new incentive models and schemes at any time during the Program once the Program's effectiveness has been assessed for Customer(s) and Lead(s).
8. PROGRAM COMMUNICATIONS
8.1 The Company will communicate with Customers about marketing, offers and more, via calls, digital platforms, email and WhatsApp. Please note that you may opt out of receiving marketing or promotional communications.
9. RIGHT TO REVOKE
9.1 Company reserves the right to revoke the participation of any Customer in the Program and/or revoke any or all benefits the Customers may be entitled to, if in the sole and absolute discretion of Company, a Customer abuses any of the Program privileges, fraudulently uses the Program, fails to comply with these T&Cs or otherwise earns benefits through deception, forgery and/or fraud.
10. GOVERNING LAW
10.1 The relationship between Customer and the Company shall be governed by, construed, and enforced in accordance with the laws of the Bengaluru (Karnataka), India, without giving effect to any conflict of law provisions.
11. GENERAL CONDITION
11.1 All decisions of the Company in any matter under these T&Cs shall be final and no discussion or correspondence will be entertained.
11.2 A failure by the Company to enforce any of these T&Cs in any instances will not give rise to any claim by any person.
11.3 Nothing herein amounts to a commitment or representation by Company to conduct further similar or other Program.
11.4 This is an electronic document and does not require any digital or physical signature.
12. MISCELLANEOUS
12.1 These T&Cs shall be subject to Company’s Terms and Conditions and Privacy Policy available on the Platform.
12.2 The Company makes no warranty or representation as to the quality or merchantability for the purpose of the Program.
12.3 In the event there is any conflict between the terms set out in T&Cs, Platform’s Terms and Conditions and Privacy Policy, the following order of prevalence shall apply: (i) T&Cs, (ii) Platform’s Terms and Conditions, and (iii) the Privacy Policy.
